Melony Michaels and her husband John Foster, victims of a mortgage fraud scam involving 1564 Hillside Ave. N. and a motley cast of dubious Northside characters, won a judgment of approximately $849,000 but collecting the judgment has not been easy.
First USA Title, one of the defendants, is appealing and oral arguments will be heard January 8, 2014, 10:40 am in Room 100 of the Minnesota Judicial Center. This according to a documented posted recently on the Minnesota courts website.
The Year Of Our Lord 2014 may be when these victims of mortgage fraud finally get justice, but I won't be counting chickens before they hatch.

They need to go after the "underwriter" (or underwriters) of First USA Title. Every small title company acts as an agent of one of the few big national title insurers (Old Republic, Chicago, Stewart, etc.).
ReplyDeleteThey have a great lawyer and I have a high degree of confidence she's on top of that. Ultimately, that might be the move they have to make, but FIRST they'll need to solidify the lower court judgment and win on this appeal with First USA Title.
ReplyDeletePerhaps you need to bone up on your contract law, John.
