This blog has previously reported and editorialized about Kevin M. Holler and Valerie Holler, property owners whose spare house at 1423 45th Ave. N. was in the path of library development. Overcoming the obstructionist stance of the property owners, Hennepin County recently voted to obtain the property by eminent domain. Since the founding of our great Republic, eminent domain has been the right of sovereign entities, albeit under the Fifth Amendment just compensation must be paid for any such "taking." This would be true under any interpretation of the Constitution, including an Originalist interpretation. Those who wish to dispute this (though they are wrong) should feel free to comment.

Word I'm receiving behind the scenes from one high-ranking city official is the Hollers (or anybody whose property is the subject of eminent domain in Hennepin County) will be crying all the way to the bank with a skip in their step.

It was about a year ago I wrote the story of how Kevin M. and Valerie Holler sank a North Minneapolis library project by refusing to sell their crap bag rental property, pictured above. Here's another blog post on the same topic, click here.

Well it turns out the Hollers are not only obstructionist dunderheads but lawsuit happy as well. Somehow I didn't catch wind of this rank odor wafting on the air, but it turns out the Hollers sued two Hennepin County Commissioners (Opat and Stenglein) plus Hennepin County itself for defamation, which is (as we all saw with the Jerry Moore v. Johnny Northside case) the last legal resort of bad actors and bit player dirtbags who are stung by the deep, probing, hurtful truth.

Here's a link to the order that resolved the Holler lawsuit at the district court level. Also, it just so happens that an email sent by the Hennepin County Attorney's Office bounced around in the email-o-sphere and found its way to me...

Patch Dot Com reported the much hoped for, much anticipated new Webber Park Library has been removed from the 2013 Hennepin County budget. Instead, improvements will be made to the old library.

Patch Dot Com said, "The action was taken because efforts to assemble properties for the site of the new library – in particular, a parcel at 1423 45th Ave. N. – were unsuccessful. Acquisition of that site was considered essential."

Of course, Patch Dot Com didn't take things to the next level and name the names of the progress-destroying, neighborhood-screwing lone hold outs.

Well, this ain't Patch Dot Com.
