Tommy Bardney, North Minneapolis Shooting Victim, Had Extensive Criminal Record (Mostly Bad Domestic Stuff Like, Oh Gee, DOMESTIC ASSAULT BY STRANGULATION)

Tommy Bardney (yes, that appears to be his legal name, "Tommy") died in a burst of gunfire on the 1000 block of Humboldt Ave. N. His family and loved ones say he was "assassinated," and though I may have scoffed a little bit when I first read that headline in the Star Tribune, subsequent reading of the facts does justify that description. (Here's another Strib story in case the first link doesn't work, it's hitting about 50/50 right now on a 404 error message)

Bardney was seated in a van talking to his wife. Based on his record of domestic violence, I'm guessing he wasn't invited inside the house...

Bardney had seven children by his wife but had only been married to her four years; kudos for trying to do the right thing, I say. Better late than never. But Bardney had a troubled life and there was a lot of domestic stuff in his court record.

27-CR-01-053003 BARDNEY, TOMMY 01/10/1979 06/28/2001 Hennepin Criminal/Traffic/Petty Downtown Crim/Traf Mandatory Closed LOITERING

Though labeled "loitering," this conviction smells like a domestic. The conditions imposed include "no contact with victims" and "stay away from 4th and 24th North."

27-CR-02-103515 BARDNEY, TOMMY 01/10/1979 01/31/2003 Hennepin Criminal/Traffic/Petty Downtown Crim/Traf Mandatory Under Court Jurisdiction ASSAULT IN THE FIFTH DEGREE TERRORISTIC THREATS

These are actually two charges. The "terroristic threats" charge was dismissed. The assault charge stuck. Conditions included "Stay out of Stand Up Franks Bar." This is the bar which has, thankfully, turned into a high-end zombie themed bar called Donny Dirk's. Bardney died owing $118 on this charge.

27-CR-04-070238 BARDNEY, TOMMY 01/10/1979 12/02/2004 Hennepin Criminal/Traffic/Petty Downtown Crim/Traf Mandatory Under Court Jurisdiction CARRY PISTOL WITHOUT A PERMIT

Convicted. Died owing $143 on this charge. I can almost understand people being released without paying their fines because acting otherwise might be construed as debtor's prison, but I say take all the money they're carrying in their wallet when they go to jail and apply it to the fines they owe. Or speed the system up a little bit and issue blanket "contempt of court" charges for not paying fines so there's something more to hold them besides "you owe money."

27-CR-06-051593 BARDNEY, TOMMY 01/10/1979 07/31/2006 Hennepin Criminal/Traffic/Petty Downtown McKinsey, E. Anne Crim/Traf Mandatory Closed BURGLARY SECOND DEGREE

Convicted. Went to prison over this one.

Died owing $155 in fines. See previous sermonette.

27-CR-06-066248 BARDNEY, TOMMY 01/10/1979 09/26/2006 Hennepin Criminal/Traffic/Petty Downtown Crim/Traf Mandatory Closed ASSAULT/DOMESTIC VIOLATION OF A PROTECTION ORDER

Convicted on the assault, the violation of a protection order was dismissed but, you know, smells like a plea bargain since he first pleaded not guilty but then later amended his plea. Didn't owe money on THIS one when he died. Hard evidence he was "just starting to turn his life around?"

27-CR-06-065040 BARDNEY, TOMMY 01/10/1979 09/27/2006 Hennepin Criminal/Traffic/Petty Downtown Crim/Traf Mandatory Closed DOMESTIC ASSAULT BY STRANGULATION TERRORISTIC THREATS

For those times when an edged weapon is just too impersonal and only bare hands will do. He was found guilty of the strangulation part but the terroristic threats charge was dismissed. Went to prison for this one, too.

27-CR-10-46397 BARDNEY, TOMMY 01/10/1979 10/05/2010 Hennepin Criminal/Traffic/Petty Downtown Brandt, Gina M. Crim/Traf Mandatory Closed Domestic Assault

Pled guilty. Had a raft of conditions imposed and also did a couple months in the workhouse but the good news is his voting rights were restored.

Now comes the point where JNS blog makes an outrageous yet though-provoking comment.

If somebody has SEVEN CHILDREN by a guy, and the guy ends up dead while all or most of the children are minors, do you know how much SOCIAL SECURITY MONEY we are talking about, here?

I don't know the exact figure, but it can safely be describe as: 

A LOT. 

I'm just saying.

Apparently, a relative could ask to have the mugshot taken down now that he's deceased. That would be a lovely and lasting tribute, in its own way.

Hi John, the Social Security money may be less than you are thinking.

I'm getting this information from SSA's publication 05-10085 (http://www.ssa.gov/pubs/10085.pdf)

First, dead Tommy would have to have worked "long enough in a job where [he] paid Social Security taxes." How long "long enough" is, isn't clear.

And, the family's maximum payment is capped: "The family maximum payment is determined as part of every Social Security benefit computation and can be from 150 to 180 percent of the parent’s full benefit amount."

Of course, welfare may well be a completely different matter.

According to Wikipedia (so it must be true), SSDI payments are based upon an average of past earnings. So with seven children, that would probably tally up to ... about $1.47 / month.

Dependent children can receive 75 percent of the benefit payment that the deceased parent would have been eligible for at full retirement age, according to the Social Security Administration's Survivors Planner. This amount depends on the amount the worker paid into Social Security and other factors. The earning record of the highest-earning parent, or primary beneficiary, is the basis for calculating the benefit amount that Social Security pays to a surviving orphan.

The average benefit paid to surviving children of eligible wage earners in May 2011 was $755, with 1.9 million beneficiaries, according to the Social Security Administration's Statistical Snapshot. This average includes payments as high as $1,775, calculated at 75 percent of the $2,366 maximum SSA retirement benefit payable as of 2011. The average also includes child survivor payments made at 75 percent of reduced payments calculated on the records of workers who elected early retirement. Once workers elect reduced payment options, SSA calculates payments to their child survivors using the benefit amount that they were receiving at death. Survivors of workers whose participation in federal, state and local government pension plans reduced their Social Security wages also receive reduced benefit payments.

Did you catch the part about how they use the income of the HIGHEST EARNING PARENT? Also, I don't see where it says it's divided up PER CHILD. It seems like that's the number and it's the number for each child unless somebody can point me to information that says otherwise.

For now I believe I can stand by my statement that the Social Security "orphan benefits" for the children, however many there are who are minors, are collectively worth quite a bit.

Yes, my trail of info was going to lead me there anyway since checking all the names through MNCIS is my modus operandi, but you did have the info first. If it's the info I think you mean.

Are you writing like that because you think it's funny? It's really not as funny as you seem to think. There is a point to be made about that whole "just getting his life together" cliche.

However, in a subsequent blog post I will be asserting this guy really was making some dramatic moves to get his life together. Probably not enough of them. But he was trying and he had done some notable and documented things to move in a positive direction.

Johnny, Thanks for your blog. You play things pretty fair, as far as I can tell. The only exception is your woefully inadequate coverage of the roving bands of Sikhs going around terrorizing the North Side - the Sikh Turban Clique, Sikh Brotherhood, etc. When will we be spared from this Sikh violence?
