REVISED, REVISED, REVISED: "Old Majority" Lawsuit Update In The Jordan Neighborhood

The "official rumor" in the Jordan Neighborhood--which is good enough to publish by loosey goosey blog standards--is that "Old Majority" Attorney Jill Clark's request for a TRO (temporary restraining order) caused two judges to recuse themselves. The lawsuit finally landed on the desk of a Judge Rosenbaum, reportedly.

Persistent rumors say at least one Jordan resident was asked to sign his name to a "complaint" without realizing "complaint" actually meant a lawsuit, with the very real possibility of a decisive and massive COUNTER suit. This is, however, unconfirmed information.

This blog remains open to receiving information from all sides of this conflict and will make an effort to publish it.

ADDENDUM: TEN SECONDS after I got this information posted, rumor came down that Judge Rosenbaum also recused herself, and the lawsuit is now on its FOURTH judge.

ADDENDUM TO ADDENDUM: Rumor Control Central says the lawsuit might still be on Rosenbaum's desk, but Rosenbaum is the FOURTH judge. Still trying to nail down the info.

Assigned: Chu (recused), Hedlund (recused), Rosenbaum (recused), Steenson-DuFresne (recused), Zimmerman (removed), Blaeser (recused), now assigned to Leung.

Remaining: Abrams, Albrecht, Aldrich, Alton, Barnette, Belois, Bernhardson, Brandt, Bransford, K. Burke, S. Burke, Bush, Cahill, Daly, Dickstein, Duffy, Garcia, Holahan, Howard, Kaman, F. Karasov, P. Karasov, Koch, Larson, Lefler, Mabley, Manrique, McGunnigle, McKieg, McShane, Meyer, Miller, Moreno, Neville, Nord, Nordby, Peterson, Porter, Poston, Quaintance, Quam, Reilly, Reding, Robiner, Swenson, Sagstuen, Scherer, Small, Sommerville, Wernick, and Wieland.

Folks, given the happy-go-lucky relationship Ms. Clark has with the bench, this could take a while. I bet it will end up with a retired judge, Stephen Swanson, Allen Oleisky, or Richard Hopper. Clark has had serious run-ins with half the bench.

Please continue to give us info as you get it!

Why was Zimmerman "removed?"

It says a lot when Judges don't even want to be bothered! As a person that does not live in the Jordan area, I look at this situation in disbelief. Makes you wonder why the "Old Majority" is going through such great lengths to regain positions. And their attorney must be mentally ill. Who in their right mind would take such a case!?

here comes my standard JNS comment....

un-freaking-believable!!!!

This ticks me off that we pay these judges a good salary and half of them are taking a step back from a messy case - HELLO! That's why it's in the courts hands!! It's messy and someone needs to sort it out and pick a side!!

In regard to the attorney being mentally ill: I don't think so. She made about $50k in attorney fees off the last Al Flowers lawsuit, while Flowers got a judgment of $3.

I have made it clear I think the lawsuit is wrongheaded, but I rise in defense of my "sister of the bar" when it comes to this particular criticism.

However, I don't think she's going to get as lucky with this case as she did with the "multi-dollar" Al Flowers judgment.

The judges were more than likely "recused" due to conflicts with the participants. If they are friends of any of the plaintiffs or respondants, had a professional relationship with one of them when they practiced law, or they had some serious run-ins with the attorney (Jill Clark). As for Zimmerman, he's a soft spoken and thoughtful man, but kind of a softy too. Clark probably had him removed because he worked a Probate/Mental Health Courtroom and would recognize insanity when he saw it.

LOL @ Zimmerman recognizing insanity!

anybody got an update re: the TRO?

Leung - recused.

Some more who wont get the case: F. Karasov will not be assigned, he is being activated by his US Army Reserve unit. Belois will not be assigned, she is the Signing Judge and does not take assignments, One of the Burkes are on assignment outside the civil block, Cahill is in Drug Court, Reilly is on the Coleman-Franken lawsuit, Bransford is assigned to Juvenile, Meyer is in Juvenile as well. Quaintance is too I just found out. I will try to get the rest of the list later.

What unfortunate fish will be found when this judicial pond is drained to reveal the very bottom of the legal food chain?!

What chicken will be forced across the road by the rest of the flock when the bloody pecking order is at last (the horror!) revealed?!

This reminds me of first grade, when nobody wanted to stand in line next to the stinky kid!

not much happened at court - Judge porter heard arguements from all the attorneys - Jill Clark vs. Al Goins, Ferd Peters, Jim Moore, Peter Michaels, Damon Ward and Ben Loetscher.

Not sure if Jill should be proud it takes 6 men to take her on, or if she should be worried. I'm betting on worried, I don't think this is going to go well for Clark, Myers Moore, Al Flowers and any other "stakeholders" - especially since the Judge specifically asked for more info on the financials. perfect. let it alllllll come out.

So...the old majority goes to court and the judge wants to look at the FINANCIAL info?

Um...that's a very interesting bounce of the ball. Wouldn't that stuff be with...the records that were taken out of the office and are now....?

Anonymous said...

yeah basically the old majority thru Jill argued that the judge should return the bank account to the control of the old majority because they need to keep the bills paid and with this new 'rogue' board (that's what they call the new majority) they have no idea if things are being paid and maintained and it would be best to return the status quo back to the old majority. So one of the defense lawyers rebutted that just about every bill was several months deliquent and his clients (new majority) have paid the bills up til the end of february. And the judge asked him for a new affidavit with all that info in it.

also, the defense attorney's were all very adamant that the judge require the plaintiff's to disclose what happened to the 'missing' equipment, state where the records/equipment are, and perhaps provide hard copies of everything that was taken for the mean time until this mess is sorted out.

rumor is the 'old majority' is not working out of JNLchurch anymore but has moved into the law offices of devongsa & myers. Just rumor, don't know how valid.
